Coalition of Leftist Attorney Generals Argue for the Power of States to Ban Common Arms :: 10/13/2023

A coalition of leftist Attorney Generals for sixteen states and the District of Columbia has filed an amicus brief to the Ninth Circuit appeal by the State of Hawaii, claiming state power to ban common arms is essential.  On August 7, 2023, a three-judge panel of the Ninth Circuit reached the unsurprising conclusion that knives, particularly the type of pocket knife called a “butterfly knife” or “balisong,” were bearable arms. Raging Against 9th Circuit’s Pro-Arms Ruling: Hawaii Gambles on En Banc Review :: 10/13/2023

Last Wednesday, the State of Hawaii filed a petition requesting en banc review (by an 11-judge panel) of a 9th Circuit three-judge panel’s unanimous ruling in Teter v. Lopez, 76 F.4th 938 (9th Cir. 2023). The Teter ruling declared Hawaii’s ban on butterfly knives unconstitutional, and the three-judge panel’s correct application of the Supreme Court’s ruling in Bruen has implications that extend well beyond just butterfly knives and well beyond Hawaii.
