One of the more interesting Second Amendment-related lawsuits floating around federal courthouses is a challenge to the federal law barring marijuana users from exercising their right to keep and bear arms. Florida Agriculture Commissioner Nikki Fried, a Democrat who lost her bid to become the Democratic gubernatorial candidate in Florida this year, filed suit (along with several individual plaintiffs) against the Biden administration, Attorney General Merrick Garland, and ATF Director Steve Dettelbach. As Ag Commissioner Fried oversees the state’s concealed carry licensing system, but the federal prohibition on gun ownership for users of unlawful substances means that even in states that have legalized medical or recreational cannabis use, medical marijuana patients have to choose between their health and their right to self-defense.

California sheriff accused of corruption claims SCOTUS gun case invalidates charges :: 09/21/2022
Santa Clara County Sheriff Laurie Smith is facing multiple charges of “willful and corrupt” misconduct for allegedly overseeing a pay-to-play scheme where donors to her re-election campaign or the sheriff’s office were able to obtain a concealed carry permit; something that was generally off-limits to the residents in the California county. This week, however, Smith sought to have those charges dismissed, arguing that thanks to the Supreme Court’s decision striking down the “may issue” laws in New York (and a handful of other states including California), she shouldn’t be prosecuted for disregarding a law that the courts have ruled unconstitutional.

South Carolina city courts lawsuit with new gun control measure :: 09/21/2022
And not for the first time, either. Back in 2019 the city council in Columbia, South Carolina approved a number of local gun control ordinances, including a “red flag” law, bans on lawful concealed carry within 1000 feet of a school, and declaring property where homemade guns were made to be “public nuisances”. South Carolina Attorney General Alan Wilson filed suit against the city, arguing that their new local laws were a violation of the state’s firearm preemption statutes, which leaves it up to the state legislature to regulate firearms, and last year a judge ruled against the city. After deliberating for months about whether to defend the laws, the Columbia city council voted instead earlier this year to repeal them.
