New York Self-Defense: Senior New Yorker Uses Unlicensed Firearm in Self-Defense, May Face Charges :: 07/07/2023

Charles Foehner, a 65-year-old retired doorman from Queens, New York, is now facing legal issues after defending himself during a failed robbery, highlighting the complicated nature of U.S. gun laws and self-defense rights.

In the early hours of May 31, Foehner was approached by 32-year-old Cody Gonzalez, whose rap sheet contains at least 15 arrests dating back to 2004 and a history of mental illness. As seen on surveillance footage, Gonzalez accosted Foehner outside a parking garage on 82nd Avenue near Queens Boulevard in Kew Gardens. Despite Foehner pulling out his silver revolver, Gonzalez continued to advance, brandishing what Foehner believed to be a knife but later turned out to be a pen.

At this point, the confrontation escalated rapidly. Foehner fired multiple shots into Gonzalez’s chest. The assailant can be seen on camera desperately fleeing down the parking garage driveway before collapsing. He was declared dead at the scene. Following the shooting, Foehner dutifully called 911, informed them about the incident, and placed his firearm in his jacket pocket, waiting for the authorities.

The aftermath of this tragic encounter, however, has seen Foehner face potentially severe legal consequences. The Queens District Attorney’s Office has stated that Foehner is expected to face charges of criminal possession of a weapon and criminal possession of a firearm. Further investigations revealed that Foehner possessed over two dozen weapons in his home, including pistols, shotguns, and an AK-47, despite being licensed for only five. This discovery has potentially compounded the charges Foehner faces.
