Have you considered the worst-case scenario?

 

 

While preparing for all of life’s unknown unknowns, are you considering the worst-case scenario?

When it is cold in the winter, you may have a heater in each room, but what if the power is out for an extended amount of time? Have you considered the worst-case scenario?

If there is a natural disaster, how you would provide clean water to your family? What if the “tap” stops? Have you considered the worst-case scenario?

PA Title 18 Chapter 61, Section 6106 reads:

Firearms not to be carried without a license.

(a) Offense defined.--

(1) Except as provided in paragraph (2), any person who

carries a firearm in any vehicle or any person who carries a

firearm concealed on or about his person, except in his

place of abode or fixed place of business, without a valid and

lawfully issued license under this chapter commits a felony of

the third degree.

(2) A person who is otherwise eligible to possess a valid

license under this chapter but carries a firearm in any vehicle

or any person who carries a firearm concealed on or about his

person, except in his place of abode or fixed place of

business, without a valid and lawfully issued license and has

not committed any other criminal violation commits a

misdemeanor of the first degree.

(b) Exceptions.--The provisions of subsection (a) shall not

apply to:

Exception #8 Reads:

(8) Any person while carrying a firearm which is not

loaded and is in a secure wrapper from the place of purchase to

his home or place of business, or to a place of repair,

sale or appraisal or back to his home or place of business, or in

moving from one place of abode or business to another or from

his home to a vacation or recreational home or dwelling or

back, or to recover stolen property under section 6111.1(b)(4)

(relating to Pennsylvania State Police), or to a place of

instruction intended to teach the safe handling, use or

maintenance of firearms or back or to a location to

which the person has been directed to relinquish firearms under 23

Pa.C.S. 6108 (relating to relief) or back upon return of the

relinquished firearm or to a licensed dealer's place of

business for relinquishment pursuant to 23 Pa.C.S. 6108.2

(relating to relinquishment for consignment sale, lawful

transfer or safekeeping) or back upon return of the

relinquished firearm or to a location for safekeeping pursuant

to 23 Pa.C.S. 6108.3 (relating to relinquishment to third

party for safekeeping) or back upon return of the relinquished

firearm.

“Secure wrapper” is NOT defined in Title 18. So that begs the question, “How would you describe a secure wrapper?”

This subject is discussed in depth during the FOAC-Institute PA Gun Law Seminars. While polling the audience what a “secure wrapper” is, answers often include:

  • a tightly wound newspaper
  • a plastic bag
  • a padded nylon zip case
  • the cardboard box the gun came in
  • a gun sock
  • a hard plastic lockable case with padlocks on it

Do you think a cop that might pull you over would agree that a tightly wound newspaper “wrapped” around your rifle, is a “secure wrapper”? How about the gun sock?

Are you considering the worst-case scenario?

Maybe it would be prudent to transport your rifle in the hard plastic lockable case with padlocks on it. Prepare for the worst-case scenario. By the way, make sure your ammo and magazines are in a separate compartment or separate container. The PA Title 18 definition of “loaded” is tricky.

Are you a “gun dealer”?

If you answer is immediately “NO”…. then maybe you might want to consider what the ATF recently did. The ATF recently moved the goal post and circumvented statutory law and the legislature by changing certain definitions in the “rules” (27CFR Part 478). These changes go into effect on May 20th, 2024.

The final rule implements the provisions of the Bipartisan Safer Communities Act (“BSCA,” effective June 25, 2022), which broadened the definition of when a person is considered “engaged in the business” as a dealer in firearms (other than a gunsmith or pawnbroker). The Final Rule clarifies that definition.

The Biden Administration, though, AG Merrick Garland via the ATF has once more overstepped their authority by creating criminal law through executive fiat. This is no surprise. This type of overstep is par for the course for the tyrannical Biden administration. However, until challenged, the rule change might classify YOU as an illegal gun dealer if you sell a firearm. This is of course a move to impose a type of universal background check, registration, and eliminating private sale of firearms.

If you privately sell a long gun, be careful, consider the worst-case scenario.

We should plan for the worst-case scenario in all aspects of our defensive strategy.

Assume that when seconds count, police will be minutes away.

Learn to use your defensive firearm in a way that works well with what the body is likely to do under stress/duress. Assume that you will have tunnel vision, auditory exclusion, threat focus, and experience the perception of slow-motion time.

Assume that you will need more ammo to stop an attacker than what your 5 shot revolver can hold. By the way, FOAC-Institute recommends carrying a modern semi-automatic with as much capacity as you can carry.

Assume you will be arrested and charged with SOMETHING if you defend yourself with a firearm. Assume that you will need to secure a criminal defense attorney and you can bet your wallet it will be expensive.

Assume that your decisions will be questioned and be prepared to articulate why you did, when you did.

Think defensively, collect and process information, make good decisions, and prepare for the worst-case scenario, and you will be less likely to be devastated by criminals and government officials.

 Sacrifice. 

What exactly does that mean to you?  Sacrifice.  The past few weeks have been chaos on the road for me.  Mill Creek, Langhorne, Newville, Butler, Long Pond…   a lot of highway miles.  This past Thursday the seminar team needed a break, but I had to be at Long Pond for a four-hour seminar with V.P. Klint Macro.  The weather was fair, so I took the Shelby and made the four-hour trip to the Pocono Raceway to present to a crowd of roughly 25 pro-gun citizens, almost half of which were brought to the room by Director Stephen LaSpina.

Powerhouse Attorney Andy Teitelman Successful in Defending Spring Grove Boy Charged By School Resource Officer over Fake Gun Seen During Zoom

Today, attorney Andrew Teitelman, with Prince Law Offices, P.C., successfully defended against the bogus charges of disorderly conduct brought by Spring Grove’s School District Resource Officer. The background of this matter is somewhat summarized by this article.

Attorney Teitelman, when asked his thoughts on the outcome, simply declared “justice prevailed in relation to these obscene and absurd charges. Based on the evidence of record and the testimony today from the school resource officer, the judge correctly dismissed the charges and we will now turn to vindicating Brandon’s rights, which were violated by the school district and school resource officer. A civil rights complaint, in the federal court, will likely be filed in the near future for violations of Brandon and his parents’ 4th, 5th, and 6th Amendment rights.”

The freedom to peaceably assemble and speak freely is enshrined in the First Amendment of our nation’s Constitution. Next Tuesday, we will exercise that right in defense of our Second Amendment: the right of the people to keep and bear arms.

In Closing

FOAC-Institute is a member of the Allegheny County Sportsmen’s League. Actually, FOAC was a direct offshoot of the ACSL legislative committee when FOAC formed in the early 1990’s.

Recently, the ACSL held the annual President’s Dinner. Each year member clubs nominate their sportsman or member of the year and the club president presents the award to the recipient at the dinner.

This year, FOAC-Institute president and team were conducting a seminar on the same night of the Presidents Dinner.

Last week, I was honored to present the award to the recipient at a Concealed Carry Seminar hosted by Rep. Abby Major.

Kevin has been a dedicated volunteer for MANY YEARS. Kevin is a FOAC-Institute life member. Kevin accompanied FOAC founder and former president Kim Stolfer on many outings, seminars and events. Kevin administers info tables at gun shows and seminars. Kevin buys space on the FOAC-Institute Gun Bash Shirts and often donates money as well as his time and talent.  

Next time you see Kevin at an event, tell him CONGRATULATIONS!

FOAC-Institute is continuing to fight for the hearts and minds of our fellow Pennsylvanians to promote individual liberties and freedoms. We are steadfast and resolute and dedicated to protecting our Constitution and advancing the cause of the 2nd Amendment and Article 1 Section 21 of the PA Constitution.

FOAC-Institute’s educational efforts are expanding across the Commonwealth. FOAC-ILLEA volunteers are teaching more concealed carry classes each month and additional virtual education events are forthcoming.

FOAC-Institute is continuing to fight in the courts. Whether this means new litigation to challenge local tyrants, fight the bureaucrats that make it harder for Pennsylvanians to exercise their most basic rights, or the funding of amicus briefs to support others who are already involved in court battles, we are actively helping to establish case law that will help advance the cause of liberty.

FOAC-Institute volunteers research proposed legislation, consult with experts, and offer advice to elected officials about legislation as well as educate the public on the strength or folly of legislation that could have lasting positive or negative effects upon our liberty and the liberty of our children.
