T’was the night before election day and all through the house, senate, and executive branches, not a creature was stirring not even a squirrel. The ballots were place in the drop box with care, in the hopes that the receptacle would not catch fire. The President is nestled all snug in his bed while visions of gun confiscation dance through his head.
As I try (very un-cleverly) to combine the popular Clemet C. Moore poem with recent events, let us not forget that tomorrow is one of most sacred days in our Constitutional Republic… ELECTION DAY.
One of the many grievances of our founders was that they had taxation without representation. Representation was a primary concern of the Founders. Election Day is our opportunity to vote for those candidates that are the most “of like mind” and will represent us. If we don’t vote we squander that the opportunity.
Many Americans claim that we need term limits. If all Americans voted in every election and knew who they were voting for and what those candidates were about….. “We the People” WOULD impost organic term limits… PROBLEM SOLVED.
The Declaration of Independence listed many grievances that the colonists had with the King. Many of the same grievances can be claimed with the Biden Harris administration. But it wasn’t till April 19th, 1775 when the Crown came for the colonists’ guns and ammo that the citizenry fired upon the redcoats.

Even though Kamala recently claimed to be someone who is “in favor” of the right to keep and bear arms, her history and actions do not pass the smell test. A recent article by Frank Miniter does a great job of illustrating this point. In the article, Miniter lists these interesting points:
Tomorrow’s election is NOT just about the Chief Executive.
There are many “down ballot” positions on the line. PA House, PA Senate, US House and US Senate seats are up for grabs and are likely MORE consequential to our freedoms than that of the President.
Bob Casey is another one that doesn’t pass the smell test. I have contacted him MANY times about 2A related issues, and I always get the same tired old stock gun control response:
“I support the Second Amendment right of law-abiding Americans to own guns for protection, sporting, and collection. But, like many Americans, I believe we need commonsense gun safety measures that will help to prevent tragic mass shootings as well as the daily gun violence that takes the lives of approximately 45,000 Americans each year.”

When a politician follows a statement with a “BUT” the first half of that statement is a lie.
Examples could include:
I am for freedom BUT…..
I am for lower taxes BUT…..
I am in favor of the 2nd Amendment BUT……
Bob Casey does not care about your individual right to protect yourself or those that you love. Otherwise, he would not hold YOU accountable for the actions of criminals by being “in favor of” commonsense gun safety measures.
How stupid does he think YOU are???

The 2005 measure — titled Proposition H — prohibited not just future sales of handguns in the entire city of San Francisco, but outright banned handgun possession for anyone except active-duty law enforcement officers, licensed security guards, and members of the military. All non-exempt gun owners were required under the measure to surrender their once-legal handguns to police.
If the current media narrative is to be believed, Vice President Kamala Harris isn’t interested in taking away anyone’s guns. She just wants reasonable, common-sense gun control. She is, after all, a gun owner herself, isn’t she?
There’s one slight hiccup in the narrative: for a politician so allegedly disinterested in taking anyone’s guns, Harris sure has a habit of trying to take a lot of guns away from a lot of people.
It’s not just that she previously supported seizing semi-automatic rifles from millions of peaceable law-abiding Americans through “mandatory buybacks” —support she only recently (and only slightly) walked back.
And it’s not just that she defended D.C.’s complete ban on the civilian possession of handguns and argued to the Supreme Court that none of us has a right to keep and bear any firearms in the first place.
And it’s not just that, in 2007, she threatened to violate the Fourth Amendment rights of San Francisco’s gun owners by sending police officers to conduct random, warrantless searches of their homes to ensure compliance with the city’s “safe storage” laws.
And it’s not even just that, as President Joe Biden’s gun control czar, she’s overseen the administration’s assault against ordinary gun owners through the unprecedented weaponization of the Bureau of Alcohol, Tobacco, Firearms, and Explosives.
No, it’s because as San Francisco’s District Attorney, she co-sponsored a successful ballot measure that, but for a technicality of state law, would quite literally have taken handguns away from every lawful gun owner in the city.

As our viewers know, almost every election cycle, we put out an article that reviews the general right to carry a firearm, while voting, and location limitations. The most recent one was: Primary Election on May 16, 2023: Carrying a Firearm While Voting – It’s Political Speech and It’s Lawful!
Today, I became aware that PA Attorney General Michelle Henry has put out false information regarding voting while carrying a firearm. Specifically, on the Voting and Election Information sub-page of her webpage, under the section “Firearms inside a polling place,” it specifies that “[f]irearms cannot be brought into polling places which are…[1] inside a private property forbidding them; [2] a school; [3] a courthouse; or [4] any other location where Pennsylvania law prohibits the carrying of firearms.”
First, in relation to “inside a private property forbidding them,” municipalities are generally, pursuant to 25 P.S. § 2727, required to utilize public, not private, property. However, regardless of whether a the property is public or private, it is under the control of the County Board of Elections during the election (see generally, 25 P.S. § 2726, et seq) and our state firearm preemption statute – 18 Pa.C.S. § 6120 – prevents all forms of local government, including counties, from regulating, in any manner, firearms and ammunition. However, even absent our preemption statute, as the public officials may not “deny or impede[] another in the exercise or enjoyment of any right, privilege, power or immunity” (18 Pa.C.S. § 5301), counties and their county officials are likewise prohibited from disenfranchising one’s right to vote, merely because the individual is carry a firearm. And this applies, in this context, against private property owners, where the private property is being used for a government function (i.e. polling); as otherwise, a Church could preclude anyone of the Jewish or Muslim faith from voting on its property, even though it is the designated polling location; or the YWCA could preclude men from voting on their property; or any location, regardless of public or private, could preclude someone for wearing a shirt with a political slogan in support or opposition of a particular Party. Moreover, as I reviewed in a recent article, there are numerous criminal offenses, including for law enforcement officers, who disenfranchise an individual by precluding that individual from voting.
Second, in relation to state courthouses, we review both of those locations in our general article on carrying a firearm while voting. While I will not go into all the specifics, contrary to Attorney General Henry’s statement, it is not unlawful to bring a firearm into a state courthouse, even if it is a polling location, as state courthouses are required to provide lockers to anyone bringing in a firearm. This includes state courthouse from the magisterial district level up to the Pennsylvania Supreme Court and everything in-between. Please note however that all federal property, including federal courthouses, are off-limits for firearms.
Third, in relation to schools, once again, Attorney General Henry fails to address the defense of “other lawful purpose,” which I litigated in Commonwealth v. Goslin. I cannot stress enough how important it is to vote, regardless of whether or not you carry a firearm. While I believe voting while carrying a firearm is a political statement, the failure of so many citizens to become involved in the political process may result in us losing our right to make any political statement, as evidenced by the current state of our Union.

We are at a crossroads in our country. This crossroads occurs EVERY election day. Election Day, by design, provides us the opportunity to have a bloodless revolution. On November 5th, 2024, we face issues and challenges that are serious as a heart attack. EVERY other day during the year we fight those within the elected class that actively seek to destroy our basic natural born, God given, self-evident rights and liberties. Thick skin, dogged dedication, steadfast resolution, and a cool head is required. It is serious work.
I spend a lot of time with pro-gun / pro-liberty advocates. We also spend a fair bit of time with anti-gun / anti-liberty advocates as we debate and argue with them. I have worked with many “woke” folks in the entertainment biz. One thing I have observed is that many of the anti-gun and woke crowd appear to thrive on misery. Pro-Liberty folk enjoy laughing at human behavior, might take a poke at the “other side” and even make fun of ourselves from time to time.
I have shared the occasional article or video from the Babylon Bee. These guys are SATIRE. Great satire hits close to reality. This article “9 More Scary Facts” is very funny. CLICK HERE and read it and laugh a bit… it is good for you.
Now, with all seriousness.
Tomorrow is the first day of the next chapter of our country. Whoever wins, there will likely be “peaceful protests”. Whoever wins, there will likely be copious lawsuits. Whoever wins, there still likely be controversary. Whoever wins, we will still have a lame lame duck anti-gun Joe Biden as our President for a few more months.
GET to the polls tomorrow and help others do the same.
