Tomorrow is Election Day!

I remember how proud I was to vote in my first election back in 1992.

I studied the candidates, watched all of the debates, learned about their positions, consulted with mentors, made my decisions, and CAST MY VOTE! I voted for President all the way down the ballot to township supervisor.

I was very proud when I left the voting booth and deposited my ballot.

Unfortunately, “my” Presidential candidate did not win in 1992, but nevertheless, I was proud to exercise my right to vote. It was one of the rights that my uncle “Ab” died for in WWII, I was not going to squander it.

Every election since his birth, my son Augie has accompanied me to the polls, and he will be with me tomorrow! Our children (and many adults) need to learn to fight the narratives that are perpetuated by the anti-Constitutional propagandists that control our media.

YOUR VOTE DOES COUNT! Don’t let ANYONE tell you different!!!!!

There may have been hanky panky at the polls throughout history. It is very likely the election was stolen from Nixon in 1960. Many folks might raise an eyebrow at more recent elections as well, but when you DON’T vote…. THEY ALWAYS win!

You must educate yourself on each individual candidate and vote for only those that will uphold the Constitution, especially (since you are reding this newsletter) those who will uphold and protect the 2nd Amendment and Article 1 Section 21 of the PA Constitution.

With an estimated 6 million+ gun owners in Pennsylvania, why the F&%K must we be forced to deal with anti-gun/anti-liberty elected officials in Pennsylvania? Well, it has to be 1 or 2 reasons. It is either because gun owners aren’t voting… or they are voting for anti-gun candidates.

Educate yourself about the candidates and vote accordingly…. But get out and VOTE!!!!

Legislators and Endorsements

November 7th is almost here.  Many of our members and subscribers are looking for voting information or past records on legislators and trying to be as informed as possible this year.  I have a request...  if you use our site for such information and you find your legislator missing, redirected inappropriately, or vote records are blank, please email me!  jstoker@foac-illea.org   

We have been fixing issues since the move to the new website and our developer has done an excellent job dealing with the wide variety of issues we've had, but now we need to pinpoint any specific gaps in the records.  Right now it appears to only be affecting freshmen legislators.  If you find one, please reach out so we can fix it.  

Many have also asked our opinion of the voters guides the FOAC-PAC organization is putting out under the leadership of President Herb Ohliger.  We support the guides and encourage their use, as they endorse candidates solely on their positions on the 2nd Amendment.  We think it best our members and subscribers be informed citizens at the polls.

What we learned, again, from the massacre in Maine

Last week, our hearts were broken once more as an evil gunman took the lives of 18 innocent people in Lewiston, Maine .

While the locations of mass shootings vary, the dynamics that lead up to these senseless tragedies are very much the same. The faces and places are unique, but the fundamentals make the storyline all too predictable.

In Maine, the suspect was an Army reservist who threatened to “shoot up” the National Guard base where he was stationed. He complained about voices in his head and even spent two weeks in a mental health facility over the summer. But despite the threats, which constitute an arrestable offense in Maine, he was still allowed to roam the streets and develop a plot to massacre nearly two dozen innocent people.

Just as predictable is the emotional but fact-deprived response from the gun control lobby. From President Joe Biden calling for an “assault weapons” ban to radical leftists pushing for law-abiding citizens to be disarmed, these programmed rhetoric exercises are baseless at best

To keep our family and loved ones safe from violence, we must crack down on criminals, who are the ones who commit crime. Similarly, to reduce the number of mass shootings in America dramatically, we must remove dangerous, threatening people, not guns, from our community before they harm someone.

This is simple logic, but political agendas and dogma often find a way to stifle common sense.

What the massacre in Maine also affirmed was the unyielding need for law-abiding citizens to be armed and disciplined. As the suspect traveled from location to location, no one returned fire. His diabolical plan was executed without interruption.

We have seen elsewhere that there is a direct correlation between the arrival time of law enforcement and the number of dead bodies on the scene. Maine was a reminder that sometimes you are on your own, and carrying a firearm could be the difference between life and death.

On the morning after the senseless act of violence rocked Lewiston, I reached out to my friend in Maine to share my condolences and offer any assistance needed. I asked if she was scared during the search for the gunman and if she had any advice for other women in her community.

“Am I scared? Not really,” said Andee Reardon, who is also a firearms and self-defense instructor at East Coast School of Safety. “The same tool that was used to terrify numerous towns in Maine is the same tool sitting next to me right now, ready to defend my home and my loved ones from harm. Now, more than ever, I refuse to be a victim, and this massacre is a sad but true reminder that you are your own first responder, so plan and act accordingly.”

As the days pass, we will learn more about the victims and their stories, the families they left behind, and the communities that are coming together to overcome the unspeakable. Law enforcement will also unearth more about the suspect, his motivations, the timeline that ended with this evil, deadly display of rage. We will hear from local leaders about efforts to keep their citizens safe as politicians in Washington and Augusta lob far-reaching legislative remedies that often undermine the Constitution while failing to alleviate any threat or danger.

It’s in these moments that Women for Gun Rights, a nationwide organization of mothers, daughters, and sisters committed to protecting the Second Amendment, will stand steadfast in pushing not for new legislation but for better education.

We will champion the enforcement of laws already on the books that take dangerous, threatening people out of our cities and towns.

We will urge ladies of all stripes to purchase a firearm and learn how to use it. Develop a safety plan and make sure your friends and loved ones do the same.

Finally, we will continue to travel this country in defense of the Second Amendment, which is a human right, that protects each one of us from harm, violence, and tyranny.

The reasoning and rationale behind a mass shooting will always be baffling. How can one person crave death and destruction without remorse? But the closing statement is always the same. Dangerous people need to be relocated and gun rights preserved. Then, and only then, can we make mass shootings a sickness of the past and not a pandemic of the future.

Underestimating the Vision of the Founding Fathers

 Many in the Anti-Liberty movement are quick to promote a false narrative that “The Founding Fathers” could not have envisioned the firepower of modern sporting arms and defensive tools. They lived in a world of flint and steel and could not imagine a world where regular Citizens would have access to direct impingement gas operated or piston driven mechanically operated firearms (you would be hard pressed to find a garden-variety ANTI that could describe them that accurately…).

The Founding Fathers were men of vision and imagination. They fought for and created a Country and System of Government that was revolutionary and had NEVER been done before. To say that the Founders could not envision advancements in technology is reasonably dis-respectful in my opinion. Heck, two of the Founding Fathers, Ben Franklin and Thomas Jefferson, were accomplished inventors; many others were doctors, designers, and engineers. They were not simply “Politicians”. They created technologies as well as our Constitutional Republic.

The Bill of Rights was ratified by all of the States in 1789. This document is a contract between “The People” (normal everyday Law-Abiding Citizens) and “The Government”. In 1789 The Founding Fathers” and “The People” recognized that the potential for Government to become a tyrannical, oppressive institution did truly exist. By explicitly documenting the freedoms of “The People”; stating that each of these Rights can not be violated or infringed, “The People” would always be the “4th Check and Balance” to the Government. Now that is some REAL vision, imagination, and foresight!

Now let us beg the question and ask, was the Bill of Rights meant to guarantee the Rights of “The People” as technology advances and society evolves? Let’s look at a list of technology, organizations, and personal property. These items, when used for law-abiding pursuit of happiness, are protected by the Bill of Rights. Most reasonable educated Citizens would agree with me.

In 1789 these religious groups did not exist. Whether you agree with their philosophy and teachings or not, they are ALL protected by the Bill of Rights:

In 1789 these advocacy groups did not exist. However, the Bill of Rights does indeed protect each organization and their members as they exercise their Right of free speech, their Right to peaceably assemble, and their Right to purse happiness.

 Bill of Rights: Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

In 1789 these technologies did not exist, but the Bill of Rights does protect our individual use of these items to aid us as we speak freely, express ourselves artistically, pursue happiness, worship, share ideas, peaceably assemble, and petition the Government for a redress of grievances. Our right to own these tools as private property is also guaranteed in The Bill of Rights.

Bill of Rights: Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

In 1789 these tools did not exist, but the Bill of Rights protects our ownership of them as private property and use of them to defend ourselves, and our country.

The Founding Fathers not only envisioned advancements in firearm technology, they counted on it. They were no doubt aware of advance technology that existed while they were writing the Constitution and Bill of Rights. Look up the Girandoni 46 caliber 20 round repeating Rifle (1780) and you will see one of many examples advanced “gun” technology of the day.

Bill of Rights: Amendment II

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

The Founding Fathers were visionaries and so were “The People” of the day. They ALL knew that Government has the potential to get out of control. They recognized that a government unchecked by the People would most certainly turn towards the side of tyranny.

So here we are today……. We have a government that has been left unchecked for many years. We have a Citizenry whose Liberties are constantly under attack from the Elected Officials who are in Government. We see the Rights and Liberties of Law-Abiding Citizens compromised, limited, and restricted all across the Country on a daily basis.

It is time that Law Abiding Citizens recognize that we ARE FREE. The Constitution and Bill of Rights guarantee this and the Court has upheld that “unconstitutional laws” are not valid.

When politicians openly violate the Rights of Law-Abiding Citizens and act as if they are above the law, “We The People” must not tolerate it.

The erosion of one Right is an attack on them all. “We The People”, the law-abiding citizens of the United States, stand together in our cause.
We are steadfast and resolute.

It is time for elected officials to stop attacking the rights of law-abiding citizens. The restriction, limitation, or destruction of Liberty is NEVER the answer.

Oppose all legislation, regulations, executive orders or rulings that undermine the rights given by God and guaranteed by the Constitution of The United States and Bill of Rights.

President Biden’s War on Firearm Industry Reaches New Peak

President Joe Biden is stepping up his effort to cripple the firearm industry, the one industry that provides the means for law-abiding citizens to exercise their Second Amendment rights.

President Biden’s Commerce Department issued a new and unprecedented edict that bans the export of firearms, ammunition and certain accessories to most overseas markets. The Commerce Department’s Bureau of Industry and Security posted a notice of a 90-day “pause” for the exports on a Friday afternoon – on the Frequently Asked Questions Section that’s listed on the bottom the BIS website. The “Friday news dump” was apparently an attempt to slip the kneecapping of the industry under the radar. However, this appears to be a coordinated event and more evidence of gun control groups steering domestic and foreign policy for the Biden administration.

Earlier Attacks

President Biden’s repulsion that Americans would actually choose to exercise their Second Amendment rights has long been clear. He labeled firearm manufacturers the enemy at the outset of his campaign for The White House. That’s a purposeful choice of words. He didn’t say the firearm industry “opposed” his policies, nor did he say it was an “adversary.” He chose to call the firearm industry “the enemy,” labeling it as an existential threat to the America he wanted to fashion during his administration.

He’s taken every opportunity to wage a campaign against the firearm industry and gun owners in general. He nominated David Chipman, a gun control lobbyist, to lead the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The ATF, of course, is the federal agency that regulates the firearm industry. His nomination was akin to putting the fox in charge of the hen house. NSSF opposed and his nomination was withdrawn. Director Steve Dettelbach was later nominated and confirmed by the U.S. Senate.

There’s also the ATF’s “zero-tolerance” policy that has seen federal firearms licenses (FFLs) revoked and businesses closed for minor clerical errors, even in cases that were addressed and closed. Some of those cases were reopened to revoke licenses and shut down businesses and livelihoods. As part of that pressure campaign, there’s been a significant increase in the number of “voluntary” license surrenders by business owners who agreed to give up their licenses instead of fight the weight of the federal government over the onerous policy.

President Biden has reached for nearly every lever of government to erect roadblocks to law-abiding citizens to exercise their Second Amendment rights and hobble the firearm industry’s ability to meet the demands of gun owners. He issued Final Rules through the Department of Justice (DOJ) and ATF to attempt an end-around Congress and redefine “frames or receivers” and ban stabilizing pistol braces. The frame or receiver rule outlawed the sale of unfinished firearm parts kits and his stabilizing pistol brace rule redefined brace-equipped pistols as short-barreled rifles, requiring that they be registered as controlled items under the National Firearms Act, requiring tax stamps and submission of fingerprints, photos and redundant background checks.

Both Final Rules are being challenged in the courts as unconstitutional. That’s because they are. The Final Rules create criminal law without the consent and will of Congress. It is important to remember that only Congress can draft laws – especially those that involve criminal punishments. When an executive authority does that on their own, that’s tantamount to tyranny.

President Biden also took aim at gun owners and hunters by kowtowing to anti-hunting and antigun special interests to ban the use of traditional lead ammunition on National Wildlife Refuges (NWRs). His administration hasn’t done this just once – but twice (and just last week). These rules phase out the use of traditional lead ammunition and require more expensive and less available alternative ammunition. It was announced that it was to protect wildlife populations from the detrimental effects of the use of traditional ammunition. President Biden promised his administration would “follow the science,” except it isn’t. There is no peer-reviewed, site-specific evidence to support the U.S. Fish and Wildlife Service (USFWS) claims. They published the rules claiming to protect human health, California condors and American bald eagles. But the sites where they are banning the ammunition don’t hold condor populations. The Centers for Disease Control and Prevention’s research demonstrates there is no human risk from consuming game harvested using traditional ammunition. American bald eagles are thriving, in large part because of the contributions paid by firearm and ammunition manufacturers through Pittman-Robertson excise taxes. That’s benefited wildlife conservation to the tune of over $25 billion since 1937, when adjusted for inflation.

Latest Salvo

Now, the Biden administration slipped in this “pause” on firearm exports. That’s significant for several reasons.

First, President Biden campaigned on reversing the U.S. Munitions List to Commerce Control List (USML-CCL) export reforms that were begun under the Obama-Biden administration and completed by the Trump administration. Those reforms reduced regulatory costs and streamlined exports while strengthening end-to-end user checks to ensure firearm exports weren’t being sent overseas to bad actors. Opponents of these reforms include disgraced U.S. Sen. Bob Menendez (D-N.J.), who coveted his Senate oversight role to bless or block any firearm exports under the old rules.

It is now apparent why he so zealously wanted that oversight back. The longtime ally of President Biden was recently indicted on federal corruption and bribery charges that stem from him greasing the skids for small-arms shipments to companies in Egypt. FBI officials raided his home and found hundreds of thousands of dollars wadded up and stuffed in his jacket pockets, along with stacks of gold bars. The twice-indicted senator has also been charged with illegally acting as an agent for the Egyptian government.

The “pause” of firearm exports is unprecedented and the timing is suspect. The Biden administration’s new Office of Gun Violence Prevention, which is staffed by gun control lobbyists and activists, just concluded a roundtable meeting with Democratic lieutenant governors to explore new ways they could collaborate on more gun control. It was also in the wake of successive Bloomberg News features that called into question exports to foreign countries, falsely alleging that U.S. manufacturers are complicit in stoking crime. One was an attack on SIG Sauer over crime in Thailand and a later article focused on Central and South America. Another attacked the Commerce Department’s role in assisting U.S. manufacturers at NSSF’s SHOT Show®, held annually in Las Vegas. That’s something the Commerce Department does for all industries.

Bloomberg News is owned, of course, by Michael Bloomberg. He’s the billionaire former New York City mayor who flamed out on his own attempt to occupy the Oval Office, ran an undercover sting to uncover illegal gun trafficking in other states without notifying the ATF or FBI that put the lives of federal agents in jeopardy and was subsequently chastised by his own police chief and the U.S. Department of Justice. He’s also the financier of Everytown for Gun Safety and their mouthpiece The Trace, the gun control group that now has office space in The White House, along with other gun control projects he funds, such as Moms Demand Action, Students Demand Action and the Center for Gun Violence Solutions at Johns Hopkins University’s Bloomberg School of Public Health. When you pay that much money to fund gun control, universities name an entire school after you.

During this so-called “pause,” the Commerce Department will conduct a “policy review to determine if changes are warranted to advance U.S. national security and policy interests. Of course, this raises concerns that under the guise of human rights, the Biden administration will attempt to undo the USML-CCL reforms, extend the “pause” indefinitely, impose unwarranted regulatory burdens to increase costs to exporters and close off overseas markets.

Purely Political

All firearm and ammunition exports are subject to Defense and State Department review, which can halt the export if there are concerns. Firearm and ammunition license applications undergo a 100 percent end-user check by the BIS Office of Export Enforcement, regardless of how long a company has been doing business with that customer, regardless of how many times the buyer was subjected to an end-user check and regardless of whether BIS has no derogatory information on that customer, even if the end-user was recently approved.  At present, no other commodity is subject to the same 100 percent check.

The kicker is that The White House has complete authority to regulate the export of firearms. That’s what exposes this “pause” as nothing less than politically motivated. In July, the Biden administration sought to create a new division within BIS called “Embargoes and Human Rights.” With the assistance of the U.S. House of Representatives Committee on Commerce, Justice and Science, this division was stopped. It could be that this “pause” for a “policy review” is political payback. There is no right to export and the decision to grant or deny a license is purely a function of the national security and foreign policy assessment of those in charge. The USML-CCL reforms give the administration complete and essential unfettered discretion. BIS invoked national security and foreign affairs as the reason for the pause.

Congressional reaction comes through the power of the purse. Congress can – and must – act through appropriations to ensure that the Biden administration is held accountable for its attempt to kneecap the industry through their unprecedented export “pause.” This is a naked attempt to hobble the firearm industry, which President Biden made clear that he despises. It is also a shameless favor to the gun control special interest groups that have bought their way into The White House that are now using foreign policy to exert their influence over domestic policy.

The American firearm industry has been called the “arsenal of democracy” because a strong and robust small arms manufacturing base has armed and equipped our law enforcement at home and our military and allies abroad. President Biden’s “pause” is an attempt to weaken that arsenal and diminish the industry that provides the means for Americans to exercise their Second Amendment rights.

Routine Maintenance for Personal Protection and Safety Equipment

This last weekend, we turned the clocks back for daylight savings. This is a great time to do routine maintenance on personal protection and safety equipment. Many folks change the batteries in their smoke detectors this time of year. Have you changed the batteries in your red dot sights? Did you change your batteries in your personal defense flashlights? Have you changed the batteries on your laser aiming devices?

Lots of folks will do these things but forget to cycle out their carry ammunition in their carry rig. If you have a gun secured next to your bed in a climate-controlled house, perhaps this is not a concern. However…..

Do you carry your gun everyday? Do you sweat all over your gun and extra mag when you mow the grass? Do you walk in and out of the house and your glasses fog up? Do you work outside exposed to the elements of nature? Guess what…. Your defensive ammo is getting wet, fogged, and sweat upon…. You are very likely degrading the integrity of the ammo that you are betting your life or the lives of your family on. My advice is anyone living in PA or similar climates, is to cycle out your defensive ammo every time you change the clocks. The amount of times I have had students on the range who were practicing with “cycled” defensive ammo and experienced hang fires and squibs have happened more than you would likely expect.

Closing Thoughts

I have re-purposed a few items in this edition of the FOAC-ILLEA newsletter. The last week has been quite hectic for all of the volunteers at FOAC-ILLEA, repurposing assets is quicker and easier, but most importantly, sometimes it can’t be said any better than how it was said “before”.

Back in 2020, I was among many folks in the 2A world who were called upon to offer a speech for the 2020 Virtual 2A Rally. This was at the height of the “government overreach and lockdown” period of the whole “covid-thing”. Rather than try and gather in person, organizers decided to hold the rally kind of like a Jerry Lewis telethon on the internet. All in all it was very successful.

As it has become somewhat of a tradition, I am going to repurpose my speech here again, because it is every bit as relevant today as it was then. CLICK HERE TO VIEW THE SPEECH.

FOAC-ILLEA is continuing to fight for the hearts and minds of our fellow Pennsylvanians to promote individual liberties and freedoms. We are steadfast and resolute and dedicated to protecting our Constitution and advancing the cause of the 2nd Amendment and Article 1 Section 21 of the PA Constitution.

FOAC-ILLEA’s educational efforts are expanding across the Commonwealth. FOAC-ILLEA volunteers are teaching more concealed carry classes each month and additional virtual education events are forthcoming.

FOAC-ILLEA is continuing to fight in the courts. Whether this means new litigation to challenge local tyrants, fight the bureaucrats that make it harder for Pennsylvanians to exercise their most basic rights, or the funding of amicus briefs to support others who are already involved in court battles, we are actively helping to establish case law that will help advance the cause of liberty.

FOAC-ILLEA volunteers research proposed legislation, consult with experts, and offer advice to elected officials about legislation as well as educate the public on the strength or folly of legislation that could have lasting positive or negative effects upon our liberty and the liberty of our children.

Volunteer to join a committee to send emails, write letters, make phone calls… NOW IS THE TIME TO DO. DON’T PUT IT OFF. “We the People” have been sitting on the sidelines too long.
