FOAC-ILLEA Newsletter - July 16, 2024 :: 07/16/2024

FOAC-Institute is a mostly single-issue organization. We are pro-gun. We fight to protect the 2nd Amendment and Article 1 Section 21 of the PA Constitution and work to expand the individual right to keep and bear arms. We are also anti-crime. Most of the crime we fight is elected officials breaking the law and violating the Constitution. However, much of this edition will focus on a heinous crime that took place right here in our beloved Pennsylvania.

A few days ago, in Butler, PA someone tried to assassinate President Trump. We have witnessed an extraordinary moment in U.S. history.

This horrible act almost took the life of President Trump, caused the death of Corey Comperatore, 50, of Sarver, and injured 2 men, James Copenhaver, 74, of Moon Township; and David Dutch, 57, of New Kensington.

The assassin was dispatched. I choose not to immortalize his name in our newsletter. I will refer to him as the assassin because, although by will of God he did not get Trump, he did assassinate Corey Comperatore.

It is my personal belief that we have witnessed gracious divine intervention on Saturday.

The death and injury of fellow Pennsylvanians is a heinous tragedy. I pray for them and their families and ask you to join me. With that said, I realize that we were spared an even bigger tragedy.

Trump literally dodged a bullet and so did our weakened Constitutional Republic. Some might say we were an inch away from total chaos and potential civil war. I thank God.

We are less than 72 hours post event and many questions remain but there are a few things we should acknowledge and consider.

The assassin (so far that we know at this point) legally had the firearm.

The assassin (so far that we know at this point) was not a prohibited person.

The assassin (so far that we know at this point) had no history of violent behavior.

The assassin (so far that we know at this point) had no history of mental illness.

A “red flag law” would not have made a difference.

Universal background checks would have made no difference.

A “high capacity” magazine ban would not have made a difference.

A mandatory storage law would not have made a difference.

A mandatory training law would not have made a difference.

A ban on so called “ghost guns” would not have made a difference.

The “gun free zone” did not make a difference.

The Butler rally was yet another example of government failure. Government disarmed the attendees of the rally and failed to provide adequate security to protect the “asset” and those in attendance.

Even though it took a little longer than I expected, the media is beginning to call for an AR15 Ban.

The Independent (a UK newspaper) said:

“The assassination attempt in Pennsylvania on Saturday night is likely to renew debate about the state of the nation’s gun laws and the proliferation of high-powered firearms like AR-style rifles, which have become the most popular firearms in America while being used in some of the deadliest mass shooting events over the last two decades.”

The Philadelphia Inquirer published an editorial that said:

“The assassination attempt on Trump is yet another opportunity to change the country’s deadly gun culture.”

Never let a serious crisis go to waste, right?

I will bet folding money that the “ban” bills will be forthcoming. Be ready for it…..

It is interesting that the left is now concerned about “political” violence. Isn’t violence just violence? It was very surprising to see and read the statements of outrage from Democrats (that were posted and published minutes after the event). These statements did not include the expected “gun” prefix but instead used “political violence”.

Political violence is a thing. It is not a new term. According to “What is Political Violence?”:

“Political violence is a difficult term to define. The main question that arises is “when is violence considered political?” Before we can answer that, we first must define the concept of violence. Kalyvas (2006) states that “[a]t the basic level, violence is the deliberate infliction of harm on people”. Although some scholars have rightly considered non-physical aspects, such as social or economic oppression, as a form of oppression (i.e., “structural” violence), we will primarily focus on the physical variety in this chapter. So, while harm can come in many types, political violence exclusively focuses on physical violence. 

Physical violence includes the use of physical force to exert power. Examples include the use of weapons by criminal gangs to mark their territory, kidnappings, mass shootings, and torture. And while many of these examples can also be considered as political violence, the simple act of violence itself does not make it political. There is another step that makes violence become political.

Political violence occurs when the use of physical harm is motivated by political intentions. For example, when violence is used to destroy a social order, but also to preserve a social order, we can consider this political violence. Thus, political violence can be used by those seeking to challenge the socio-political status quo. And it could involve those who want to defend that same status quo.”

Sounds like political violence has been encouraged and fomented by the left since at least the summer of 2020. I guess now is the time to dial it back. I agree. However, to me it sounds like the pot is calling the kettle black. Kinda like that person who tells offensive Jewish jokes but says it’s “ok” because he has “Jewish friends”.

In Biden’s oval office address yesterday, he didn’t hesitate to pepper his speech with political rhetoric and inconstant messaging.

My fellow Americans, I want to speak to you tonight about the need for us to lower the temperature in our politics and to remember, while we may disagree, we are not enemies.

Days before the assassination attempt, Biden allegedly said in a phone call to donors:

“I have one job, and that’s to beat Donald Trump. I’m absolutely certain I’m the best person to be able to do that. So, we’re done talking about the debate. It’s time to put Trump in a bull's-eye."

Bullseye?

In an interview with NBC’s Lester Holt, Biden walked it back.

The bottom line is this. Be ready for further calls from the left for the restriction and abolishment of individual liberty under the guise of safety. The 2nd half of 2024 will likely continue to be filled with surprises.

God willing, we will be able to begin to correct our Constitutional Republic’s path come November. Let us use the ballot box not the battle box.

Be vigilant.

FOAC-ILLEA Challenges Unlawful Firearm Discharge Ordinance in Pen Argyl

Today, Chief Counsel Joshua Prince of the Firearms Industry Consulting Group (“FICG), a division of Civil Rights Defense Firm, P.C., filed a letter on behalf of Firearm Owners Against Crime – Institute for Legal, Legislative and Educational Action (FOAC-ILLEA) with Pen Argyl Mayor Male and Borough Council regarding their recent consideration and adoption of an unlawful and unconstitutional firearm discharge ordinance.

As addressed in FOAC-ILLEA’s letter to Mayor Male and Borough Council, in direct defiance of the legion of precedent from the Pennsylvania Supreme and Commonwealth Courts, the proposal seeks to regulate the discharge of firearms in the Borough. As our viewers may remember, in Firearm Owners Against Crime, et al v. Lower Merion Township, the Commonwealth Court ruled that discharge provision are preempted under Pennsylvania’s firearm and ammunition preemption statutes.

As this ordinance constitutes a criminal offense, FOAC-ILLEA is prepared to file private criminal complaints with Northampton County District Attorney Stephen Baratta if the Ordinance, and any other illegal firearm regulation, is not immediately repealed.

Pennsylvania is Our Home, Let Us Fight for It with Respect

During Clinton's presidential campaign, asserting that Pennsylvania serves as a microcosm of the United States. With Philadelphia on the East Coast and Pittsburgh on the West Coast, quipped James Carville, the seasoned political pundit, once offered a striking analogy that everything in between was Alabama.

As someone born in Alabama, whose parents' attempts at Yankification failed, I found Carville's comparison compelling. Pennsylvania has indeed become home to me, embodying the diversity and complexity of America in its vast expanse. It mirrors the broader tapestry of our nation, where urban centers coexist with sprawling heartlands that often feel neglected by coastal elites who dictate trends from afar. This dichotomy underscores a larger narrative of resilience and independence, rooted in the very fabric of our nation's history.

From the bustling streets of Philadelphia to the blue-collar neighborhoods of Pittsburgh, Pennsylvania showcases the diversity of American landscapes and cultures. Yet, the essence of America's heartland thrives in the spaces between these iconic cities—the communities and landscapes embody the spirit of self-reliance, hard work, and community solidarity.

This heartland spirit is not just a geographical phenomenon but a cultural and political force. It represents the values that have shaped our nation since its inception—the ideals of freedom, justice, and opportunity for all. It's here, in the heart of America, where decisions are made not by distant bureaucrats but by everyday citizens who understand the realities and challenges of their communities.

The resilience of Pennsylvania's heartland is evident throughout American history. From the writing of the Declaration of Independence and the Constitution in nearby Philadelphia to the pivotal battles of the Revolutionary War fought on its soil, Pennsylvania has been at the forefront of America's struggle for liberty and self-governance. FOAC-Institute Encourages Citizens to take the fight to City Hall!

I would like to share an email sent to be from a member.

Hi Klint, 

I wanted to tell you of an encouraging event that happened a few days ago.

I had just finished reading Joshua Prince's email about how the FOAC was taking action against a township near Lancaster who is trying to ban the discharge of firearms, when a coworker came into my office. She wanted to tell me that a local township, Lackawannock Township, Mercer County, was having a meeting that night to discuss an ordinance banning the discharge of firearms.

She knows where I stand on 2A issues and she wanted me to attend the meeting. I was not able to go, but I showed her the email and armed her with copies of the relevant laws.

I asked her how it went when I saw her next and she reported that she didn't get a chance to pass out the copies because 92 people showed up to make their voices heard that night. 92! This is a small township.

The Supervisors quickly realized the error of their ways and put an end to the effort.

It is encouraging to know that The People are willing to stand up and be counted, and that the local government, at least, is still willing to respond.

TIME SENSITIVE - A Call for Action: Attention Members in the Harrisburg Area

Okay folks, this one is a bit out of the norm. 

We have an active lawsuit against the City of Harrisburg that has been pending in court for nearly TEN years. The court has decided to take up the case just recently, and as you can imagine, a LOT has changed in ten years.  One, obviously, is that our dear Kim Stolfer is no longer with us to be the plaintiff he was when the case started.  Counselor Prince and I have worked through the affidavits to carry on the case with me stepping into that role.  The second is not so easy... 

At the time of the filing, we had an organization member who was under 18 years of age and resided in Harrisburg, willing to be the "aggrieved".  Kim kept that name confidential, but we have to assume that individual is no longer under the age of 18.  That leaves us with a gap in our case where we wanted to address part of their ordinance that addressed possession of firearms by minors.  

We need a member of the organization (family of an active member) who is under the age of 18, to carry out that redress of their ordinance.  As of right now, it is in name only, just showing that we still have someone affected by their illegal ordinance, not for a court appearance.  The purpose is more to enable me to testify that that particular section harms a current member of our organization.  Not to put them into the case for testimony.  I may not even be required to provide a name, just be able to truthfully state that the ordinance is affecting a minor affiliated with FOAC.  

Anyone willing to do so please reach out to me ASAP.  Trial date is Wednesday July 17th.

In Conclusion

Recently, FOAC-Institute lost a longtime friend and pro-liberty activist, Harry Lewellen. Harry was involved with FOAC from its founding in the early 1990’s. Harry Lewellen will be missed.

Recently FOAC-Institute gained a new member of the board of directors. Lizzie Jackovich.

Lizzie came to FOAC-Institute in the fall of 2019 after taking a firearms course with VP Klint Macro. She started as a volunteer at the gun bash, took on the responsibility of chairwoman of the gun bash committee and now she has accepted appointed to the FOAC-ILLEA Board of Directors. She takes a lot of pride in her work ethic and has big visions for the future of our organization. 

She grew up in an all military/law enforcement family and enjoyed archery, fishing and shooting guns with her dad. Her father, grandfather, and uncle were all police officers and former military. Lizzie is very passionate about law enforcement and protecting the second amendment.

Her family mentors taught her about firearms safety and the responsibility that comes with gun ownership self-defense and now she passionately teaches her own children the very same values.

Her love of the outdoors and adventure led her to moving to Anchorage Alaska in 2009. She spent a few years learning the land and navigating its challenges. She climbed various mountains and hiked numerous trails that ultimately led her back to Pennsylvania in 2012.

Lizzie is ready to make an impact on the Commonwealth and has the drive and determination to furthering the fight for our 2nd amendment rights. 

Lizzie lives in Clarksville, PA with her husband Dan, and her three children Parker, Lincoln & Rowan.

When you see Lizzie at the gun bash or at an event, say hello and congratulate her on her appointment.

FOAC-Institute is continuing to fight for the hearts and minds of our fellow Pennsylvanians to promote individual liberties and freedoms. We are steadfast and resolute and dedicated to protecting our Constitution and advancing the cause of the 2nd Amendment and Article 1 Section 21 of the PA Constitution.

FOAC-Institute’s educational efforts are expanding across the Commonwealth. FOAC-ILLEA volunteers are teaching more concealed carry classes each month and additional virtual education events are forthcoming.

FOAC-Institute is continuing to fight in the courts. Whether this means new litigation to challenge local tyrants, fight the bureaucrats that make it harder for Pennsylvanians to exercise their most basic rights, or the funding of amicus briefs to support others who are already involved in court battles, we are actively helping to establish case law that will help advance the cause of liberty.

FOAC-Institute volunteers research proposed legislation, consult with experts, and offer advice to elected officials about legislation as well as educate the public on the strength or folly of legislation that could have lasting positive or negative effects upon our liberty and the liberty of our children.
