Can a state ban all new handguns? According to a 2-1 panel of the Ninth Circuit, the answer is yes. A pending cert. petition asks the U.S. Supreme Court to consider the question. I filed an amicus brief in support of petition, on behalf of professors (including VC's Randy Barnett) who teach Second Amendment law, and also on behalf of several civil rights organizations (the Independence Institute, where I work; the Millennial Policy Center; and Mountain States Legal Foundation).

The Gun Grenade in the Hands of the Supreme Court :: 02/07/2019

The Supreme Court rolled a grenade into constitutional jurisprudence and the world of public safety in 2008 when it held in Heller v. District of Columbia, 554 U.S. 570 (2008), that the Second Amendment entitles individuals to possess handguns in their homes. Eleven years later, that grenade has yet to detonate because since Heller, the court has not decided a single case about whether the Second Amendment right extends further, and the lower courts consistently have rejected attempts to expand the right.

Federal Court Rules Firearms Prohibition Against an Individual for a Misdemeanor Conviction Under Vehicle Code is Unconstitutional :: 02/04/2019

Today, Joshua Prince and myself secured another victory for Second Amendment jurisprudence in Miller v. Sessions, et al., 2:17-cv-02627 in an issue of first impression across the United States. Judge Eduardo Robreno of the Middle District of Pennsylvania ruled in a 25 page memorandum that it was unconstitutional, as-applied to Mr. Miller, to prevent him from exercising his Second Amendment right as a result of a 1998 misdemeanor conviction under the vehicle code – specifically, the alteration of a PennDOT window tint exemption form.

Law Barring Illegal Aliens From Having Guns Is Constitutional :: 01/10/2019
