West Virginia Self-Defense: St. Albans shooting appears to be self-defense, police say :: 01/18/2017

A 71-year-old St. Albans man told police he shot a 27-year-old man Tuesday when the younger man attacked him, according to a news release from the Kanawha County Sheriff’s Office.

Kanawha County Metro 911 received a report about a shooting at about 11:15 a.m. at 421 Moses Street in St. Albans. Kanawha sheriff’s deputies responded and found a man who had been shot about a block away.

Detectives say they conducted interviews and determined that Jeremy Rucker, 27, attacked Lemuel Rogers, 71. Rogers told deputies he shot Rucker to defend himself.

Rogers allows Rucker and his wife, who are homeless, to use the home to shower, deputies say.

Rucker’s injuries did not appear to be life-threatening. He was taken to Charleston Area Medical Center’s General Hospital.

A deputy took Rogers to Thomas Memorial Hospital. He was treated and released Tuesday afternoon.

Detective Sean Snuffer of the Kanawha County Sheriff’s Office said Rucker was in stable condition.

No charges were filed Tuesday.

“A complete report will be submitted to the prosecutor to determine if any charges will be filed,” Snuffer said.

Initial reports that two people had been shot turned out to be incorrect, deputies said.
