NACOGDOCHES, Texas — No charges are filed after officials investigate a man who was fatally shot in a suspected home invasion in Nacogdoches this past Saturday.
Officials identified the man who died from a fatal shot as Brandon Horton, 34.
According to police, officers arrived at a residence in the 700 block of Rock Oak St. Saturday around 4:15 p.m. to reports of a possible home invasion in which one man was shot and killed.
After a preliminary investigation, officials determined a woman and man were inside the house before Horton arrived at the residence.
Horton did not live at the residence and police say he knocked at the door but after no response he used a large metal object to break down the door. Police say Horton entered the residence and broke down a bedroom door where the man and woman were hiding.
According to officials, the man inside the bedroom had a firearm which he used on Horton.
Immediately after the shooting, the woman and man called 911. Both were questioned by investigators and were cooperative in the investigation. At this time, no charges have been filed, officials said.
This case will be send to the Nacogdoches District Attorney's Office for presentation to the grand jury.
