A College Station resident shot a man in the leg after finding him burglarizing his garage Tuesday afternoon, police said.
Officers responded to the 3200 block of Wildrye Drive in the Southwood Valley-area of College Station at 3:21 p.m. for reports of deadly conduct, followed by shots fired. By 3:30 p.m., they had detained a Navasota man near the intersection of Rock Prairie Road and Normand Drive.
The 30-year-old resident of the home on Wildrye Drive told investigators he found a man burglarizing his garage, armed himself with a gun and told the man he was calling police before the two got into a confrontation that ended when the resident discharged his handgun, wounding the man, according to a press release from College Station police. It was unknown late Tuesday how many shots had been fired.
David Pinon, 23, was treated for a non-life threatening injury to his left leg and charged with burglary of a habitation, a second-degree felony punishable by up to 20 years in prison, as well as unauthorized use of a vehicle, a state jail felony punishable by up to two years in jail, after investigators linked him to a 2011 Dodge Avenger reported stolen in Grimes County and found in front of the residence on Wildrye Drive.
The resident was not harmed and will not face charges, police said. "Anyone is authorized to use force, up to and including deadly force, in response to unlawful force against them if they feel in fear of death or serious bodily injury," Lt. Chuck Fleeger said.
