HARRISBURG, Pa. -- Pennsylvania's highest court says a county judge acted properly when he appointed a special prosecutor to look into grand jury leaks tied to the state attorney general's office.
The Supreme Court ruled Tuesday against Attorney General Kathleen Kane, who had challenged the appointment after a grand jury recommended she be charged criminally for leaks of secret material.
The court's main opinion says a suburban Philadelphia judge "acted within his authority and sound prerogative" in appointing lawyer Thomas Carluccio to investigate the leaks.
Carluccio led a grand jury looking into a complaint that material from a 2009 investigation was reported last year in the Philadelphia Daily News.
The grand jury's recommendation is in the hands of the Montgomery County district attorney.
