Michigan Self-Defense: Accused robber shot by Mount Clemens gas-station cashier pleads to 14 charges :: 03/12/2020

A man who was shot by a gas station clerk while committing the last of three robberies entered pleas and agreed to spend 17 years in prison.

Allan Moore, 28, of Clinton Township, pleaded no contest Monday in Macomb County Circuit Court to 14 charges related to the incidents last spring.

His attorney, Michael J. Steinberg, reached a deal with Judge James Maceroni to sentence Moore to 15 years, at the bottom of the sentencing guidelines, on top of a mandatory two years for five counts of possession of a firearm during the commission of a felony.

He is scheduled to be sentenced April 9.

Moore was captured after he was shot six times May 4 by a cashier at the Mobil gas station on Main Street south of downtown Mount Clemens after stealing cigarettes. He was arraigned in a bed at McLaren Macomb hospital in Mount Clemens.

The county Prosecutors Office did not file criminal charges against the gas station employee, a 25-year-old Detroit man. The worker fired after Moore aimed a .22 caliber handgun, which was stolen, at him and pulled the trigger but did not fire. The worker had a valid permit to carry the 9-millimeter handgun he fired at Moore.

Police discovered Moore also committed a robberies at Family Dollar stores, in Mount Clemens and Clinton Township, within the prior six weeks.

Steinberg said the multitude of charges against his client led to relatively high sentencing guidelines.

Moore also had prior offenses. On March 27, 2019, he was sentenced by Judge Maceroni to time-served, 137 days, and three years probation, with the first 90 days on tether, on two counts of first-degree retail fraud for incidents in October and November 2018 in Clinton Township, according to Macomb Circuit Court records.

Moore also faces probation violations in those cases due to the robbery charges.

Steinberg said his client is in obvious discomfort from his gunshot injuries. Moore spent multiple weeks in the hospital.

“He had to recover from his injuries in a jail cell,” Steinberg said. “A lot of people might not have sympathy for him, but it is a form of punishment.”

In all, Moore pleaded to five counts each of armed robbery and felony firearm, three counts of receiving and concealing and one count of a felon in possession of a firearm.

The no contest pleas serve as admissions in criminal court but provide some protection in civil court.
