A judge is giving a gun-rights group more time to argue why its lawsuit challenging Ohio State University over its weapons ban shouldn’t be dismissed.
The Students for Concealed Carry Foundation says the ban restricts constitutionally protected rights, including the right to self-defense by Ohio State students living in university housing.
The lawsuit in Franklin County Common Pleas Court says the ban restricts the rights of both lawful gun owners who want to carry weapons openly and holders of concealed-carry permits.
Earlier this month, Ohio State asked Judge Daniel Hogan to dismiss the lawsuit, arguing that the group hasn’t shown how the ban harms its individual members.
Hogan agreed on Monday to give the group more time to respond to Ohio State’s request.
