California Self-Defense: 70-year-old Sanger man pulls gun on burglar, detains him until police arrive :: 01/31/2016

A burglar allegedly attempting to steal property from a Sanger house Thursday night was surprised when the 70-year-old homeowner met him with a raised handgun and ordered him to the ground.

Fresno County sheriff’s spokesman Tony Botti said Enrique Garza, 54, broke into the man’s home in the 2300 block of South Lewis Lane around 6 p.m. Deputies received a call around 6:30 p.m. from the homeowner, who said he had caught Garza stealing property.

The homeowner had been working in his yard before he tried to enter his home through the front door, Botti said. The security door was locked, but the man remembered leaving it open. He drew his registered handgun from his pocket and entered through a window.

He found Garza inside and pointed the gun at him. The man ordered Garza to put his hands up, go outside and sit down in the front yard until police arrived. The sheriff’s Eagle One helicopter captured footage of the homeowner detaining Garza.

Garza was booked on a felony burglary charge and a probation violation, as well as a misdemeanor drug possession charge.

Botti said the man has had a permit through the sheriff’s office to carry a concealed weapon for 50 years, but this the first time he had drawn his gun on another person.
