Alabama Self-Defense: Mobile Co. Sheriff's Office: Man shot and killed in apparent self defense :: 04/29/2023

The Mobile Co. Sheriff report on a man shot and killed in apparent self defense in Grand Bay.

According to MCSO, on April 29, 2023, 12:00 am, Mobile County Sheriff’s Office responded to 13750 Fred Freeland Rd, Grand Bay AL in reference to one shot. Deputies made entry into the residence and discovered the victim, Oliver Turner, deceased of an apparent gunshot wound.

Detectives interviewed the homeowner, 80-year-old Lee Eubanks on scene. Eubanks was elderly and gave a limited statement. Eubanks stated that on this date, Turner had been drinking heavily and acting belligerently. Eubanks stated that Turner was a friend who had been staying at the residence for the past several days. Eubanks stated that on this evening, Turner was acting “out of his mind” and attempted to set the residence on fire with himself, Michelle Jones (Eubanks’ niece), and Jones’s 8 year old daughter inside. Eubanks stated that he was fearful for his safety and Jones shot Turner.

Michelle Jones, niece of Eubanks, stated that on the same date listed above, she returned home and observed Turner acting belligerently. Jones stated that shortly after returning home, she discovered that the exterior of the residence was on fire. Jones also stated that she tried to go to bed but then Turner dragged her from her bed attempting to pour acetone all over her inside a bathroom. Jones stated she fled the bathroom and ran to get her 8-year-old daughter. She and her daughter got into her vehicle and Jones ran back inside to check on her uncle. Jones went into her room to get her revolver for protection. When Jones exited her bedroom, Turner advanced towards her and she fired on shot out of fear for her life. Turner was pronounced dead at the scene.

Detectives observed scratch marks on Jones’ neck and minor injury to her right hand palm. Turner has an extensive violent criminal history to include a 2021 arrest for Arson 1st Degree.

The evidence located on scene, and Jones observed injuries were consistent with Jones statement. The investigation is ongoing and will be presented to a grand jury at a later date.
