Criminal Complaint Filed in Montana Gun Free School Zone Case :: 09/15/2023

A preliminary appearance has been scheduled for Gabriel Cowan Metcalf on the charge of possessing a firearm in violation of the federal Gun Free School Zone Act in Billings, Montana.  The Gun Free School Zone Act is a controversial law that had been found to be unconstitutional in 1994 and then was slightly altered. It has not been considered by the Supreme Court since 1994, long before the Heller, McDonald, and Bruen decisions. The preliminary appearance will be on Monday, 28 August, at 9 AM. The criminal complaint has been posted.

More lawsuits filed, first hearing delayed in challenge to NM governor's carry ban :: 09/12/2023

There’ve been at least six different lawsuits filed in response to New Mexico Gov. Michelle Lujan Grisham’s order imposing a 30-day ban on open and concealed carry in the city of Albuquerque; the latest coming from the Second Amendment Foundation, Firearms Policy Coalition, and the New Mexico Shooting Sports Association. In their complaint, the groups maintain that Grisham’s order is “in flagrant violation of Plaintiffs’ right to carry firearms in public for self-defense, a right that has been clearly established by the United States Supreme Court,” and “perversely target[s] the right to carry in the places where self-defense is most necessary.”

NSSF Files Amicus to Inter-American Court of Human Rights :: 08/21/2023

WASHINGTON, D.C. — NSSF®, The Firearm Industry Trade Association, filed an amicus brief in response to a request for an advisory opinion submitted by Mexico to the Inter-American Court of Human Rights (IACHR). NSSF argues the Court should decline Mexico’s invitation to issue an advisory position as Mexico is attempting to use the Court to bolster their erroneous $10 billion lawsuit against U.S. manufacturers and undermine the bipartisan Protection of Lawful Commerce in Arms Act (PLCAA) passed by Congress in 2005.

Everytown files lawsuit on behalf of shooting witnesses :: 08/18/2023

Lawsuits are often filed not to right wrongs but to punish people who don’t conform in some way. This is typically called “lawfare” and groups like Everytown are big proponents of it. They like to try and sue companies not because the companies did anything actually wrong, but because they’re businesses that are involved in the firearm business.

Ohio appeals court upholds preemption law in blow to anti-gunners :: 08/17/2023

The fight over Ohio’s firearm preemption law is likely headed back to the state Supreme Court after the state’s 10th District Court of Appeals overturned a lower court decision to grant an injunction against the law’s enforcement, at least as it applied to several local ordinances passed by the city of Columbus.

Gun Lobby Challenges Unconstitutional Illinois Law Attacking Free Speech :: 08/15/2023

NSSF, The Firearm Industry Trade Association, filed a legal challenge to Illinois’ unconstitutional law that seeks to muzzle firearm manufacturers’ and retailers’ First Amendment right of free commercial speech and to regulate industry members’ commercial conduct in every state of the Union. Gov. J.B. Pritzker signed the Firearm Industry Responsibility Act into law, and NSSF immediately filed its challenge.
