A bill removing the limits on how long government may retain background check information when searches yield no clarity. This means the government could potentially hold onto applicant information without obligation to purge even if there has been no criminal or disqualifying conduct by the applicant.
Title: National Instant Criminal Background Check System (NICS) Data Integrity Act of 2020
Subject: Crime and law enforcement: Criminal justice information and records: Firearms and explosives: Government information and archives
Description: Modifies requirements governing the national instant criminal background check system (NICS). Specifically, it allows the NICS to retain records related to a firearms-related background check for as long as necessary to make a final determination of firearms eligibility. Additionally, it requires the NICS to query an additional database—the National Data Exchange—as part of a firearm-related background check.
